AN OBERON man has been gaoled for repeatedly driving while disqualified and banned from obtaining a licence or driving again until 2033.
Peter John Kirk, 50, was sentenced last week to 12 months gaol with a non parole period of nine months for driving an unregistered prime mover on O’Connell Road about 4.10pm on Thursday, February 12.
Relieving magistrate Allan Moore revoked a 250 hour community service order imposed on Kirk at Parramatta Local Court in July, 2006 and replaced it with a concurrent six months gaol sentence.
Mr Moore added two years to the disqualification of Kirk from driving or holding a licence, extending it from December 27, 2031 to expire on the same date in 2033.
Solicitor Peter Ringbauer entered a guilty plea on Kirk’s behalf agreeing with a police statement of facts tendered to the court.
It outlined how Kirk, of Lowes Mount Road, Oberon had driven the prime mover for a rush repair job to get it passed for registration when stopped by a police patrol.
Mr Moore took into account how the prime mover had been unregistered since February 1 nearly two weeks before Kirk decided to drive from a property to Oberon to have repairs carried out.
The court was told the police who pulled Kirk over checked and found he had been disqualified from 1994 and his licence would not be returned before the 2030s.
Other information before Mr Moore included Probation and Parole reports dating from the time Kirk had been sentenced by Parramatta Local Court to perform a total of 250 hours community service as an alternative to gaol on July 3, 2006.
Kirk, according to the reports, had put off working for the community because he claimed to be in employment.
He had failed to comply with the order and Mr Moore revoked it, imposing a concurrent gaol sentence in Bathurst.
